In fact, the penalties for kratom in Arkansas are possibly the strictest in the nation, with possession of less than 2 grams (a minimal dose) of kratom being a class D felony and more than 2 grams to under 28 grams a class C felony. Over 28 grams is a class B felony and is punishable by up to 20 years of jail time or up to $15,000 in fines.

This bill would remove kratom from the state’s list of controlled substances, thereby allowing the sale of kratom products to adults. It would also include regulations to ensure user safety, including preventing the sale of synthetic kratom products.
It still must pass the House and be signed into law by the governor, but it’s made great progress… more progress, in fact, than kratom laws have made since 2015 in the Natural State.
New rules for Kratom in Florida
While things are moving in a positive direction in Arkansas, the opposite is true of Florida. Kratom is legal in Florida, but on April 1st, HB1489 passed out of committee. This bill would add restrictions on kratom, including allowing only certain businesses to sell kratom products. That would mean limited access to kratom products for citizens, so you might not be able to find your favorite Super White capsules or other kratom products.
While it’s not as bad as an outright ban, it’s still not the direction that kratom users are hoping for. If you live in Florida, it might be time to send your representative an email.
Good new about Kratom in Iowa
Earlier in the year, Iowa legislators proposed two bills – one good and one bad. The good bill is a Kratom Consumer Protection Act that helps add regulations that protect kratom users without outlawing it altogether. That bill might continue to progress as the year goes on.
The other bill would make kratom a Schedule I Controlled Substance, banning kratom in the state and adding severe penalties for sale & possession of the plant. This would be a terrible outcome for Kratom users in Iowa and around the country, but we have some good news.
The ban bill hearing was cancelled on March 4th, and as of April 10th, it doesn’t look like it will proceed this year. That means that kratom should be safe in Iowa for a while.
Good news about Kratom in Mississippi
House Bill 1077 is likely to be signed into law soon, as it’s going to the governor’s desk. This bill would add regulations without banning kratom altogether.
For example, it would require you to be 21 to buy kratom in Mississippi and ban synthetic products altogether. That means you might not be able to get any extracts but will still be able to get powdered leaf.
We see this as a win, mostly. That’s because some representatives wanted to ban kratom altogether or make it a Schedule III drug. That didn’t happen, protecting kratom for users in Mississippi over the age of 21.
Another bill would likely make Kratom products more expensive. That’s because it would add a 25% excise tax for kratom, which is even more than the tobacco tax. That wouldn’t be good, but it’s still better than a ban.
Good news about Kratom in South Dakota
In January of 2025, the South Dakota House passed a bill that would expand their current laws that already prevent anyone under the age of 21 from buying kratom.
This bill would add labeling, including pregnancy warnings, while also banning the addition of synthetic products to kratom. None of this is too worrisome, but the bill still needs to pass the Senate and be signed into law, so if you live in South Dakota, make sure you keep an eye on the potentially changing laws.
Bad news about Kratom in Texas
Texas recently added Kratom to a controlled substances bill that would completely ban kratom in the Lone Star State. Luckily, the most recent changes to the bill take kratom from being added as an illegal controlled substance to being a regulated product.
That’s great news for anyone in Texas, but how would the bill, that’s already passed through the Senate, actually change kratom laws?
